Contest Official Rules

“SUMMER SOCCER PROMOTION OASIS®” CONTEST

1. Contest Period

The “Summer Soccer Promotion Oasis®” Contest (the “Contest”) held by A. Lassonde inc. (the “Sponsor”) begins on May 16th, 2016 at 0:00:01 (Eastern Daylight Time) and ends on July 29th, 2016 at 23:59:59 (Eastern Daylight Time) (the “Contest Period”).

2. Eligibility

The Contest is open to all Canadian residents who have reached the age of majority in their province or territory of residence at the time of their participation in the Contest. Are not eligible to participate in the contest employees of the Sponsor or of its affiliates, of their representatives and agents, of the promotion agencies related to the Contest or of their suppliers, and for employees or subcontractors of a provincial liquor board, as well as any person with whom such person resides or any member of his or her “immediate family”. For the purposes of these Rules, “immediate family” shall include the father, mother, brother(s), sister(s), children, husband, wife, or partner of such person, whether or not such person resides in the same household.

3. How to Enter

NO PURCHASE NECESSARY. To enter, the Participant (“Participant”) must register through the Contest application form of Oasis Canada available at the following address: www.oasis.lassondestage.local/soccercontest (the “Contest Site”), fill in a registration form online and validate it as indicated. There are two methods to enter:

(i) By completing a registration form online at www.oasis.lassondestage.local/soccercontest . All of the fields on the registration form must be completed, unless the information is indicated as being optional. Any registration form on which the required information is incomplete or inaccurate may be declared ineligible to the Contest. The Participant will receive one ballot for the draw by registering as outlined above. The Sponsor reserves the right to request proof of identity or of eligibility to the Contest at any time and at its sole discretion. Only one (1) Participant per registration form. Each Contest Participant may only use one postal address and only one e-mail address to register through the Contest Site. Only one (1) Participant per Entry per dayper household per postal address and per computer and IP address during the Contest Period. The Sponsor reserves the right, at its sole discretion, to disqualify any individual who contravenes or attempts to contravene these Rules. Automated entries are prohibited, and any use, whether direct or indirect, of automated devices will cause immediate disqualification of the Participant and its accomplices, and the Sponsor reserves all of its rights and recourses against the user of such automated devices and its accomplices.

(ii) If it is impossible for a Participant to submit a participation ballot, the Participant may register for the contest by mail by providing the following information in printed characters on a blank page (the “Postal Participation Ballot”): (a) his or her full name, full postal address, daytime telephone number and e-mail address; and (b) a confirmation that the Participant has reached the age of majority in his or her province or territory of residence. The Participant must send this Postal Participation Ballot to: Oasis soccer contest, 160, rue Saint-Viateur Est, suite 810, Montreal, (Québec) H2T 1A8.

To be eligible, the Postal Participation Ballot must be postmarked before the Contest end date (July 29th, 2016) and be received at the address provided above no later than August 8th, 2016. In the event a Participant who has submitted a Postal Participation Ballot is selected, the selected Participant must, before being declared a winner and at the latest five (5) business days following the Sponsor’s notice, answer a mathematical skill-testing question, following the arrangements made between the Sponsor and the selected Participant.

4. Prize

Three (3) grand prize (“Grand Prize”) will be awarded in this Contest. Each Grand Prize consists of:

(a) A pair of tickets (centre field) for the Montreal Impact or the Toronto FC or the Vancouver White Caps (approximate retail value (“ARV”) of $ 200 CAD);

(b) Two (2) return economy air fare tickets for a regularly scheduled commercial flight on an airline chosen by the Sponsor for the Participant and one Guest (as defined below) to the destination airport, either Montréal-Trudeau (Quebec), or Toronto-Pearson (Ontario), or Vancouver International (B.C.). Departure points for the flights will be the Canadian international airport closest to the place of residence of the Grand Prize Winner, either Stanfield (Halifax), Montréal-Trudeau (Quebec), Toronto-Pearson (Ontario), James Armstrong Richardson (Winnipeg), Calgary International (Alberta), Edmonton International (Alberta) or Vancouver International (B.C.) (ARV of between $ 700 CAD and $ 1,900 CAD per person);

(c) Ground transportation from the destination airport to the destination hotel in Montreal or Toronto or Vancouver and from the hotel in Montreal or Toronto or Vancouver to the departure airport (ARV $ 45 CAD and $ 55CAD of between per person).

(d) Hotel accommodations in Montreal or Toronto or Vancouver for one (1) night in a luxury hotel chosen by the Sponsor, in one (1) double occupancy room (ARV of $ 300 CAD per night);

(e) One (1) dinner for two (2) people, at one of Montreal or Toronto or Vancouver’s most wicked restaurants chosen by the Sponsor (ARV of $ 250 CAD);

(f) Ground transportation from the hotel to the soccer field (round trip), and from the hotel to the restaurant (round trip) (ARV of $ 200 CAD)

The ARV for each Grand Prize is $ 2,905 CAD, excluding applicable taxes, for a total ARV of $8,715CAD. Air travel is subject to the terms and conditions of carriage of the relevant airline. Hotel accommodation is subject to the terms and conditions of the relevant hotel. Registrations in the Event are subject to the terms and conditions of the Event organizer. Flight and ticket reservations are at the Sponsor’s entire discretion and must be arranged by the Sponsor.

Each Grand Prize Winner must choose a maximum of one (1) guest (the “Guest”) at his or her discretion. The Guest must travel on the same flight and stay in the same room as the Winner. The Winner and the Guest are responsible for ensuring that they each have the required travel documentation. The Guest must complete and sign a Release Form whereby the Guest confirms that these Rules have been complied with and that the Sponsor and any organisation participating in the award of the Grand Prize or the Contest and their respective employees shall have no liability for any harm, accident, loss or misfortune related to the Contest, the Grand Prize, or the award of the Grand Prize. No guest under 18 years of age will be booked unless accompanied by a person who is 18 years or older. A parent or legal guardian must accompany all guests under the age of 18. A minor will not be allowed to participate in any portion of the prize without being accompanied by his/her parent or legal guardian. If the Guest is a minor, the Release Form must be signed by such Guest’s parent or legal guardian.

Each Grand Prize Winner and the respective Guest must be able to travel on the dates set forth under these Rules. Once booked, travel reservations cannot be modified. If it is impossible for the Grand Prize Winner and the Guest to travel on the dates and at the times specified by the Sponsor, the Grand Prize will be awarded to another Participant, in the manner set forth in Section 6, or will otherwise be completely cancelled, at the Sponsor’s sole discretion. Each Grand Prize Winner and the respective Guest must comply with applicable laws and regulations when using the Grand Prize.

Twenty (20) Secondary Prizes (“Secondary Prizes”) will also be awarded in this Contest. The Secondary Prizes are valid for two (2) people and include:

(a) A pair of tickets for the Montreal Impact or the Toronto FC or the Vancouver White Caps (ARV of $ 70 CAD);

The total ARV of the twenty (20) Secondary Prizes is one thousand four hundred dollars ($ 1400 CAD), excluding applicable taxes.

5. EXCLUSIONS

The following expenses are excluded from the Grand Prize and Secondary Prizes and are the sole responsibility of the Grand Prize Winner and the Guest and of the Secondary Prize Winner and the Guest:

(a) Any other transportation other than as set out in the description of the Grand Prize with the understanding that no transportation is provided for the Secondary Prize;

(b) Lodging, other than as set out in the description of the Grand Prize with the understanding that no lodging is provided for the Secondary Prize; and

(c) All other expenses which are not specifically included in the description of the Grand Prize and Secondary Prize, including personal items, travel insurance, service charges, and telephone, facsimile, cable, cleaning, room service and valet service fees and gratuities.

6. DRAW

Three (3) finalists for the Grand Prize (the “Grand Prize Finalists”) and twenty secondary prize finalists (“Secondary Prize Finalists”) will be chosen during a random draw among all eligible participation ballots received in accordance with these rules. The draw will be held on August 12, 2016 at the offices of Celsius Communications, 160, rue Saint-Viateur Est, suite 810, Montréal, (Québec), H2T 1A8 at 11:00 (est). Odds of being selected depend on the number of eligible participation ballots received.

All Grand Prize Finalists and Secondary Prize Finalists will be notified by e-mail or telephone within five (5) business days following the date of the draw. In the event the Grand Prize Finalists and/or Secondary Prize Finalists do not return the telephone call or do not respond to the e-mail sent by the Sponsor’s representative within a period of five (5) business days following the first contact, the Grand Prize Finalist and/or Secondary Prize Finalists will be disqualified and a second finalist will be chosen among all remaining eligible participation ballots. In the event the Sponsor is unable to notify the second finalist within a reasonable period or if the second finalist does not return the telephone call or does not respond to the e-mail sent by the Sponsor’s representative within a period of five (5) business days, such second prize finalist will be disqualified and the Sponsor will have the right, at its sole discretion to cancel the award of the prize (as defined below).

In order to be declared a Grand Prize Winner or a Secondary Prize Winner, the Grand Prize Finalists and/or Secondary Prize Finalists must complete and sign a declaration and release form (the “Declaration and Release Form”) acknowledging and confirming that these rules have been complied with and that the Sponsor and any organisation participating in the award of the Prize or the Contest and their respective employees shall have no liability for any harm, accident, loss or prejudice related to the Contest, the Grand Prize, or the award of the Grand Prize or that of the Secondary Prize.

The Declaration and Release Form, completed and signed, must be received by the Sponsor by September 1st, 2016 at the latest. Otherwise, the Grand Prize and/or Secondary Prize will be deemed to be forfeited.

7. Personal Information

By entering the Contest, each Participant consents to the collection, use and disclosure by the Sponsor or its authorized agents of the Participant’s personal information provided through the registration form for the purpose of carrying out the Contest and delivering the Grand Prize. Once submitted, the registration forms become the exclusive property of the Sponsor and will not be returned.

The personal information may be transferred to third parties that are retained by the Sponsor to perform storage, management and other similar functions, subject to the laws applicable to the protection of personal information and the Sponsor’s internal policies regarding personal information. Files containing personal information will be kept at the Sponsor’s or its service provider’s offices or on their servers and employees who require access to personal information in order to fulfil their job requirements will have access to these files. To the extent provided by applicable law, the individuals concerned may request access to the file containing their personal information and the correction of such information by contacting the Sponsor c/o Celsius Communications, 160, rue Saint-Viateur Est, suite 810, Montréal, (Québec), H2T 1A8.

By accepting the Grand Prize and/or Secondary Prize, a Winner grants to the Sponsor the right to, in any way in relation with the Contest, its promotion or its organization, produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, disseminate, adapt, use and reuse his or her name, address (city, province), voice, declarations, image, photos or other representations or recordings for publicity purposes using any media and in any format, including, without limitation, on the Internet, without any notice or compensation, and the Winners may be required to sign a document to this effect.

8. ERRORS

The Sponsor reserves the right to cancel any registration forms containing errors. The registration forms which have been tampered with or have been deteriorated, modified, falsified, reproduced or obtained illegality will not be eligible. Without limiting the generality of the exoneration set forth in Section 10, it is understood that the Sponsor and any organization participating in the management of the contest or in the delivery of the Grand Prize and/or Secondary Prize, and their respective representatives and employees, will not be responsible: (a) for any information which is insufficient or incorrect related to the users of the Contest Site or of the equipment or program used in the context of the Contest, or of a technical or human error which could occur when the forms or ballots are being processed; (b) for forms or ballots that are stolen, destroyed, accessed without authorization or altered; (c) for problems or technical malfunction related to networks, telephone lines, online computer systems, servers or access providers, computer equipment and software, viruses or bugs; (d) for the Sponsor not being able to receive or send an electronic message or email, for any reason whatsoever, including traffic congestion on the internet or on any website or both; (e) for damage caused to the Participant’s or another person’s computer system or equipment as a result of participating in or downloading material in relation to the Contest.

9. RIGHT TO CANCEL, SUSPEND OR MODIFY

By entering the Contest, each Participant agrees to be bound by these Contest Rules, available on the Contest Site throughout the Contest period. The Sponsor reserves the right to modify or cancel these Contest Rules without notice, provided it has obtained the required approvals from the Régie des alcools, des courses et des jeux du Québec.

Subject to the foregoing, the Sponsor may change as well as partially or completely terminate the Contest at any time if, at its sole discretion, the Sponsor believes that the Contest is not taking place as expected for any reason whatsoever, including because of fraudulent manipulation, destruction, loss or theft of the registration forms or ballots or any other problem which could jeopardize the fairness or integrity of the Contest.

No communication or correspondence will be exchanged with Participants, other than Participants who have been selected as potential winners of a prize.

10. General Conditions

By entering or attempting to enter the Contest, each Participant or potential Participant agrees to forever exonerate, release and hold harmless the Sponsor and its administrators, directors, employees, shareholders, agents and other representatives, its parent-company, and its affiliates from any and all claims, actions, damages, demands, courses of action, causes of actions, or responsibility of any kind whatsoever resulting from or related to the participation or attempted participation in the Contest, the compliance or non-compliance with these Contest Rules, or the acceptance or use of the Grand Prize and/or Secondary Prize. In the case of a discrepancy between the French version and the English version of these Official Contest Rules, the French version will take precedence.

The Sponsor reserves the right, at its sole discretion, to exclude from the Contest and any other contest or future promotion offered by the Sponsor any Participant who does not comply with these Official Rules.

All decisions of the Sponsor and of the organisation judging the Contest with respect to any and all aspects of the Contest are final and without appeal. The Contest is subject to all applicable federal and provincial laws and municipal regulations. The Grand Prize and/or Secondary Prize are not transferable. The Grand Prize and/or Secondary Prize must be accepted as is and without substitution in cash or otherwise, except as agreed to by the Sponsor. The Sponsor reserves the right to substitute a prize of equivalent value if the Grand Prize and/or Secondary Prize cannot be awarded as provided for by these Official Contest Rules. The Sponsor and others who benefit from the exoneration will not be liable for participation ballots that are illegible, incomplete, modified, lost or delivered late or to the wrong addressed, which ballots shall be deemed null. The use of automated systems is prohibited. Only the selected Participants will be contacted. No prize will be awarded until the Winner has been confirmed pursuant to these Rules.

If, following an error related to the participation process, the draw or any other aspect of the Contest, there is a greater number of Winners selected than these Rules provide, a random draw will be carried out between all potential Winners eligible to claim the Grand Prize or Secondary Prize in order to be compliant with these Rules.

In the event of a dispute related to the person who validated the ballot online, such ballot will be deemed to have been validated by the authorized account holder of the electronic address submitted at the time the ballot was validated. For the purpose of these Contest Rules, “authorized account holder” shall mean the physical individual who has been assigned an electronic address by an Internet access provider, Internet service provider, or any other organization responsible for assigning electronic addresses for the domain related to the electronic address at issue. The selected Participant may be required by the Sponsor to provide proof that he or she is the authorized account holder of the electronic address indicated on the selected participation ballot.

The Sponsor reserves the right, at its sole discretion, to exclude from the Contest and any other Contest or future promotion organized by the Sponsor, any person guilty or suspected of being guilty of having tampered with the treatment of the registration forms or ballots or the Contest process or the Contest Site, of having violated these Official Rules or having acted in a disloyal manner or in a manner which adversely affects or is intended to disturb, abuse, threaten or harass another person. a Participant or any other person who attempts to deliberately damage a website or hinder the legitimacy of the Contest process commits criminal and civil offences, and the Sponsor reserves the right, in such case, to CLAIM DAMAGES TO THE EXTENT PERMITTED BY LAW.

11. Intellectual property

All intellectual property covering the promotional material and the Contest Site are the exclusively property of the Sponsor or its affiliates or licensors. All rights are reserved. Unauthorized copyright or use of any copyright material or intellectual property without the express written consent of its owner or holder is strictly prohibited.

12. Applicable Law

These are the official rules for the Contest. This Contest is governed by federal, provincial and municipal law and regulations. Subject to the approval of the Régie des alcools, des courses et des jeux, these Contest rules may be modified without notice including without limitation in order to render it compliant with federal, provincial or municipal laws or with the policies of an entity having jurisdiction over the Sponse.

13. Régie des alcools, des courses et des jeux

For Quebec residents, any dispute respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any dispute respecting the award of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

14. LIST OF WINNERS

Within thirty (30) days following September 1st, 2016, the Sponsor will publish the name of the Grand Prize Winners on the Contest Site for a period of at least thirty (30) days.

Individuals participating in the Contest acknowledge having read and accepted these Rules and agree to comply with them.
